Sexual Misconduct: Don’t Get Falsely Accused!
Hi. This is Christina Williams from Just Criminal Law. It's all we do. Having defended many men in the wake of the Me Too movement, has been interesting. I've seen the pendulum swing to where it is today. Police are being told or trained to assume all accusers of sexual assault are being truthful. But we all know people lie. Unfortunately, some accusers are lying. Statistically sexual assault is the most falsely reported crime. This is, of course, devastating to the person being falsely accused but it also hurts actual victims of sexual assault because society then second guesses them. You can protect yourself against ever getting into a situation in which your being falsely accused of sexual misconduct by using some common sense. So keep these next few things in mind. Number one, avoid being alone with someone who's had too much to drink, drinking too much can lead to people making bad choices and regretting their decisions or forgetting their decisions, which may lead to a false accusation. Number two, keep company that is close to your same age. Just being courteous or friendly to someone younger than you can be perceived the wrong way by others, especially a jury. Number three, don't get involved with someone who's already in a relationship and you shouldn't be with. Sometimes the accuser makes false reports to get out of trouble, meaning she's been caught cheating. If you're the third party in a love triangle, you're at risk Number four, if you're accused, don't explain your side to the police being falsely accused of sexual misconduct. Can be shocking. And most people want to explain their side, but don't do it. If you find yourself in a situation where you're being questioned by the police, I want you to remember these three things. Number one, let them know you do not wish to discuss your day and ask if you're free to leave. Number two, let them know you want a lawyer.
